1. Introduction

Welcome to MyExportDeal.co.uk (“MyExportDeal”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the MyExportDeal.co.uk website (the “Site”) and any purchase of vehicles or parts through our platform. By accessing, browsing, or using this Site and our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use this Site or our services.

2. About MyExportDeal and Our Services

MyExportDeal.co.uk is a platform that acts as a direct seller of export vehicles and parts. We facilitate the listing of available vehicles and automotive parts for export, coordinate aspects of export logistics, and provide channels of communication with customers interested in purchasing these items. Our role includes:

  • Listing Inventory: We list vehicles and parts (new or used) available for export sale, complete with descriptions, specifications, and pricing.
  • Direct Sales: We (or our affiliated partners) are the sellers of the listed vehicles and parts, meaning transactions are typically between you (the buyer) and MyExportDeal as the seller.
  • Logistics Facilitation: We can assist in arranging export shipping and logistics upon request, helping to coordinate transportation and necessary export documentation.
  • Customer Communication: We maintain communication with prospective buyers to answer questions, provide additional information, and facilitate the sales process (via email, phone, or other direct contact methods).

Important: MyExportDeal.co.uk does not currently handle online payment processing or offer any online subscription services. All payments for purchases are conducted off-platform (for example, via bank transfer or other agreed methods), and there are no recurring subscription fees for using our Site or services.

3. Use of the Site and Eligibility

By using MyExportDeal.co.uk, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, and legally capable of forming binding contracts. You agree to use this Site only for lawful purposes and in accordance with these Terms. When using our Site, you must:

  • Provide Accurate Information: Ensure that any personal information or details you provide to us (for example, when making an inquiry or creating an account) are accurate and up to date.
  • Maintain Account Security: If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately of any unauthorized use of your account.
  • Prohibited Activities: Refrain from misusing the Site. You agree not to engage in activities such as: introducing viruses or malicious code; attempting to gain unauthorized access to the Site or our systems; using the Site in a way that violates any laws or regulations; or interfering with other users’ use of the Site. We reserve the right to suspend or terminate your access if we suspect any misuse or harmful behavior.

By complying with these usage rules, you help keep the platform safe and reliable for all users. Failure to meet these requirements may result in termination of your access to the Site, cancellation of orders, and/or legal action where appropriate.

4. Vehicle and Parts Listings & Descriptions

We strive to ensure that all vehicle and parts listings on MyExportDeal are presented with accurate and up-to-date information. Each listing typically includes details such as make, model, year, mileage, specifications, condition, and price, as well as photographs. However, please note the following regarding our listings:

  • Accuracy of Information: While we make every effort to verify that descriptions and specifications are correct, errors or omissions may occur. We do not guarantee that the content of any listing (including pricing, specifications, and availability) is error-free or complete. If we discover a material error in a listing you have inquired about or ordered, we will inform you as soon as possible and correct the information.
  • Vehicle/Part Condition: We describe the condition of vehicles and parts to the best of our knowledge (for example, noting if a vehicle is used, any known defects, or if a part is new or refurbished). That said, all items are sold on an “as is” basis unless expressly stated otherwise. It is your responsibility to review the information provided and, if needed, request additional details or arrange an inspection.
  • Photographs: Images of vehicles and parts on the Site are for general illustration purposes. They are typically of the actual item listed, but in some cases, a stock or sample photo may be used (this will be indicated if so). Colours and conditions may appear differently in photographs; we recommend relying on descriptions and physical inspections (when possible) alongside images.
  • Availability: Listing an item on our Site does not guarantee that it is still available at the moment of your inquiry or order. All listings are subject to prior sale. We regularly update our inventory, but if an item has been sold or is otherwise no longer available, we will inform you when you inquire or attempt to place an order.

By proceeding with an inquiry or purchase, you acknowledge that you understand the listing information may have minor inaccuracies and you agree that MyExportDeal will not be held liable for innocent mistakes or slight discrepancies. We encourage all buyers to ask questions and, if feasible, arrange independent inspections for complete confidence.

5. Pricing and Pricing Disclaimers

All prices for vehicles and parts listed on MyExportDeal.co.uk are given in Great British Pounds, (GBP) Euros (EUR) and US Dollars (USD) unless stated otherwise. These prices are set with export sales in mind and are subject to the following conditions and disclaimers:

  • Price Accuracy: We aim to ensure that all prices on our Site are accurate. However, pricing errors may occur (for instance, due to typographical mistakes or technical errors). We reserve the right to correct any pricing errors. If you order a product that was listed at an incorrect price, we will inform you of the correct price as soon as we notice the error:
    • If the correct price is lower than the listed price you paid, we will refund the difference if payment has been made.
    • If the correct price is higher than the listed price, we will give you the option to proceed with the purchase at the correct price or cancel the order. We are not obligated to provide the vehicle/part at the incorrectly listed lower price.
  • Price Changes: All prices are subject to change without prior notice. Market conditions, exchange rates, and other factors can influence vehicle and part pricing. Once you have paid a deposit or full payment for an order, the price for that order is fixed and will not change. However, if no payment has been made yet, updated pricing on the Site may apply to your intended purchase.
  • Quotes and Pro Forma Invoices: If we provide a written quote or pro forma invoice for a vehicle/part (for example, including shipping cost or multiple items), that quote is generally valid only for a specified period (e.g., 7 or 14 days, as stated on the quote). After the validity period, the quote may be subject to revision.

Always review the price details and ask us if you are unsure about what is included in the price. We strive for transparency in pricing so you can make informed purchasing decisions, but final responsibility for understanding the total cost (including any additional taxes or fees in your country) lies with you as the buyer.

6. Orders, Deposits and Reservation Policy

When you decide to purchase a vehicle or part from MyExportDeal, the process typically involves placing an order and, in many cases, paying a deposit to secure that item. Our policy on orders and deposits is as follows:

  • Placing an Order: You can place an order by contacting us through the Site (such as using an inquiry form or via listed contact details). Once we confirm availability and any final details (price, shipping, etc.), we will issue you a Pro Forma Invoice or Order Confirmation outlining the item(s) being purchased and the terms (including any deposit required, final payment due, and timeline). No contract is formed until we issue an order confirmation/invoice and you have paid any required deposit.
  • Deposit Requirement: To reserve a vehicle or part, we typically require a deposit. The standard deposit amount will be communicated to you (often a percentage of the total price, e.g., 10% of the purchase price, or a fixed amount for parts or lower-priced items). The purpose of the deposit is to demonstrate your commitment and enable us to hold the item for you.
  • Reservation Period: Upon receiving your deposit, we will mark the vehicle or part as “Reserved” for you and will not sell it to another buyer during an agreed reservation period. The length of this reservation period (for example, 7 days, 14 days, or another timeframe) will be specified in the order confirmation or invoice. You must complete the purchase (i.e., pay the remaining balance) within this period.
  • Non-Refundability of Deposits: All deposits are non-refundable except under the limited circumstances described below. This means if you decide not to proceed with the purchase, change your mind, or fail to pay the remaining balance within the agreed time, you will forfeit the deposit. The non-refundable deposit policy compensates us for lost opportunities and costs incurred (such as re-listing delays or administrative work) when an order is not completed by the buyer.
  • Refund of Deposit (Exceptional Cases): In certain situations, a deposit may be refunded. These include:
    • If we are unable to complete the sale due to our own fault or decision (for example, if we withdraw the vehicle/part from sale, if the item becomes unavailable or is found to have an issue that prevents sale, or if we reject the order for any reason not caused by your breach). In such cases, we will refund your deposit in full.
    • If you have paid a deposit and subsequently the item fails a pre-shipment inspection or test that was agreed as a condition of sale, you may be entitled to a refund of the deposit, depending on the circumstances and prior agreement. (For instance, if we agreed that the sale was contingent on a successful third-party inspection and it significantly fails that criteria, we won’t hold your deposit.)
  • Order Cancellation by Buyer: If you wish to cancel an order after paying a deposit but before completing full payment, you should notify us immediately. As noted, the deposit will not be refunded (except in the exceptional cases above). We may at our sole discretion consider refunding part of the deposit if we quickly find an alternative buyer or under compassionate circumstances, but this is not guaranteed and should not be expected.
  • Order Cancellation or Termination by Seller: We reserve the right to cancel your order in certain cases, including but not limited to: failure to pay the balance within the agreed period, inability to verify the legitimacy of the transaction or buyer, suspicion of fraud, or unexpected issues with the vehicle/part (e.g., discovered stolen vehicle, or export restriction). If we cancel the order due to buyer’s breach (such as non-payment), the deposit will be forfeited. If we cancel due to an issue on our side (not related to any fault by you), we will refund your deposit (and any other payments made) in full. We will communicate the reason for any such cancellation.

By placing an order and paying a deposit, you acknowledge and accept this reservation policy. Please be certain you intend to complete the purchase before you place an order and pay a deposit. If anything is unclear about the item or the terms, ask for clarification before paying the deposit. This helps avoid misunderstandings and ensures a smooth transaction for both parties.

7. Payment Terms and Methods

MyExportDeal.co.uk does not process payments through the website, so all payments for vehicles or parts are handled via offline methods as agreed with you. Once you have a confirmed order, the following payment terms and methods apply:

  • Invoice and Payment Instructions: After you place an order and we confirm availability (and receive any required deposit), we will issue a detailed invoice. The invoice will list the item price, any additional charges (e.g., agreed shipping costs, insurance if applicable), deposit received (if any), and the remaining balance due. It will also provide payment instructions, such as our bank account details for wire transfer.
  • Payment Method: Payments are generally accepted via bank transfer (wire transfer) in GBP, EUR or USD unless another currency or method is agreed upon in writing. We currently do not accept credit card payments, PayPal, or other online payment methods directly through the Site. If you require an alternative payment method, discuss it with us — we may accommodate certain methods (like an escrow service or letter of credit) on a case-by-case basis, but only with prior agreement.
  • Payment Timeline: The remaining balance (after deposit) must be paid in full within the timeframe indicated on the invoice/order confirmation. Typically, the balance is due before the vehicle or parts are released for collection or shipping. We will not release or ship any item until full payment has been received and cleared. If you anticipate any delay in payment (for example, due to international banking times or financing arrangements), inform us and we may adjust the reservation period if reasonable. Failure to pay within the agreed timeline, without prior arrangement, may result in cancellation of the order and forfeiture of your deposit (as outlined in the Reservation Policy above).
  • Bank Charges and Exchange Rates: When making an international payment, you are responsible for all bank charges or fees so that the full amount due arrives in our account. If you are paying in a different currency (only if we explicitly agree to accept another currency), the exchange rate and any conversion fees will be your responsibility. Always check with your bank to ensure the correct amount in GBP is received on our end.
  • Payment Confirmation: Once you have made a payment, especially for large sums like vehicle purchases, please send us a payment confirmation or remittance advice (such as a bank confirmation slip or screenshot). This helps us track the payment. However, note that we will only consider the payment received once our bank confirms the funds are cleared. After receiving full payment, we will provide you with a payment receipt and coordinate the next steps for pickup or shipping.
  • No Finance or Credit Terms: Unless explicitly agreed in a separate written contract, all sales are on a cash (or cleared funds) before delivery basis. MyExportDeal does not offer financing, credit terms, or installment payment plans through the Site. If you require financing, it is your responsibility to arrange it with a third-party provider. The timeline for payment remains your responsibility regardless of any third-party financing arrangements.
  • No Subscription or Recurring Charges: As noted, we do not have any subscription services. You will never be automatically charged on a recurring basis by MyExportDeal. Each transaction and its payment are individually agreed. Be wary of any request that seems to charge you regularly – it is not from us.

By making a payment to us, you confirm that you are using a valid account or method belonging to you (or that you are legally authorized to use) and that the funds are obtained lawfully. We reserve the right to decline a transaction if we have concerns about fraud or money laundering. In such cases, we may request additional verification or use an escrow service for security. Your cooperation in the payment process helps ensure a smooth and secure transaction.

8. All Sales Final – No Returns or Exchanges

All sales made through MyExportDeal.co.uk are final. Due to the nature of exporting vehicles and parts, once a sale is completed and the item is collected or dispatched for delivery, we do not accept returns, cancellations, or exchanges except under extraordinary circumstances required by law or explicitly agreed upon. Please review the following carefully:

  • Inspection Prior to Sale: We strongly encourage you to thoroughly inspect any vehicle (or have a trusted third-party inspect it on your behalf) before completing the purchase. For parts, ensure that the part is exactly what you need (correct part number, compatibility, etc.) before ordering. We can often assist in facilitating inspections or provide additional photos/videos upon request. Once you are satisfied and proceed to payment and collection/shipment, you are accepting the item in its present condition.
  • Sold “As-Is” (No General Returns): Vehicles and parts are sold on an “as-is” basis, meaning that after the sale, no refunds or returns will be given for issues or faults that were not objected to prior to sale. It is your responsibility as the buyer to verify that the item meets your requirements before finalizing the purchase. We do not offer a “change of mind” return policy.
  • Exceptions – Legal Rights: This policy of final sale does not affect any statutory rights you may have. For example, if you are considered a consumer under the laws applicable (such as the UK Consumer Rights Act), and the item was misrepresented or not as described, you may have legal remedies. Our intention is not to override mandatory consumer protections, but rather to clarify that we do not offer voluntary returns or guarantees beyond what the law requires.
  • Faults After Sale: We do not warranty vehicles or parts after they have been delivered, unless a specific warranty is provided in writing for a particular item. If a vehicle or part develops a fault after the sale is completed, any repairs or maintenance will be the responsibility of the buyer. (If the manufacturer’s warranty or a third-party warranty applies, you would need to seek remedies through that warranty provider.)
  • Cancellations Post-Delivery: Once a vehicle or part has been delivered to you or your agent, the transaction is closed. We will not entertain cancellation or return requests due to issues like change of heart, financial difficulties, or finding an alternative elsewhere. The only potential consideration for a return would be if we had a separate written agreement allowing for it, or if law mandates it due to a serious misrepresentation.

In summary, please be sure of your decision to buy before making payment and taking delivery. We invest considerable effort and cost in preparing items for export, and the finality of sales allows us to offer competitive export deals. If you have any doubts, do not hesitate to ask questions or even delay the purchase until you are certain, rather than rushing into a final sale.

10. Delivery, Shipping, and Collection

MyExportDeal offers assistance with delivery and shipping of vehicles and parts to your desired destination, or you may choose to collect your purchase. Responsibilities and processes for delivery, shipping, and collection are outlined below:

  • Collection by Buyer: You have the option to collect the vehicle or parts in person (or through an authorised agent) from our designated location in the UK or Lithuania. Collection must be scheduled and agreed in advance. The item will only be released after full payment has been received and cleared. At the time of collection, you (or your agent) will be required to present identification and proof of purchase. We may also ask you to sign a collection confirmation or handover document acknowledging receipt of the item in good order.
  • Delivery within the UK: If you need the vehicle or parts transported to a UK port or another location within the UK (prior to export or handover to your shipper), we can help arrange transport via road or carrier. Any costs associated with such transport will be your responsibility unless otherwise agreed. We will provide an estimate for approval before confirming transport arrangements. While we select reputable transporters, we are not liable for their services; any contract for road transport is between you and the transport provider (though we can act as your agent in arranging it).
  • International Shipping (Export): For overseas buyers, we can facilitate international shipping. This may include:
    • Arranging shipping by container or roll-on/roll-off (RoRo) for vehicles, or air freight/courier for parts, depending on size and urgency.
    • Preparing necessary export documentation such as the bill of lading, export certificates, commercial invoice, packing list, and any required customs forms.
    • Coordinating with freight forwarders and shipping agents to book space on a vessel or plane.
    • Insurance: By default, shipments are not insured for loss or damage in transit unless you request and purchase shipping insurance. We strongly recommend considering marine or cargo insurance for high-value items. We can often help you obtain insurance coverage at your cost if needed.
  • Shipping Costs and Payment: The cost of international shipping (and insurance if applicable) is the buyer’s responsibility. We will usually ask for shipping costs to be paid upfront (either included in your invoice or via a separate invoice) so that we can pay the shipping company on your behalf. Alternatively, we may connect you with the shipping company to pay them directly. Shipping will not be booked until payment for shipping costs is arranged or confirmed.
  • Risk and Title Transfer:Title (ownership) to the vehicle/parts passes to you once full payment has been received. However, the risk of loss or damage to the item passes to you at the point of collection or dispatch:
    • If you or your agent are collecting the item, risk passes at the time you take possession.
    • If we are handing over the item to a third-party shipper or transport agent for delivery to you, risk passes to you when the item is delivered into the custody of that shipper/agent. We will ensure the item is in good condition and properly secured at handover, but from that point onward it is at your risk.
  • Delivery Timeframes: Any delivery or shipping times we provide are estimates. While we work to meet estimated timelines, we are not liable for delays caused by third-party shippers, port congestion, customs clearance, or other factors beyond our control. We will keep you informed of any known delays and assist in resolving issues, but delays will not be a valid reason for cancellation once the item is in transit.
  • Buyer’s Responsibilities on Arrival: When a vehicle or part arrives at the destination (your country’s port or address):
    • You are responsible for clearing the item through customs in the destination country, including paying any import duties, taxes, and fees applicable. Ensure you have all necessary paperwork (which we will have provided, such as the invoice and export documents) to present to customs.
    • You are responsible for local transport from the port of entry to your final destination (unless door-to-door delivery was specifically arranged).
    • For vehicles, you are responsible for any modifications or certifications needed to register and use the vehicle in the destination country (e.g., emissions or safety compliance, registration inspections, etc.). MyExportDeal cannot guarantee that a vehicle will meet the requirements of your country; we provide information on specifications, but you must verify local compliance.
  • Failure to Take Delivery: If, for any reason, you fail to take delivery of the vehicle or part (for example, you do not pick up the vehicle from port in time, or you fail to provide necessary documents for customs clearance), any resulting storage charges, penalties, or return shipping costs will be your responsibility. We will try to assist if possible, but if the item is returned or seized due to your failure to act, we cannot refund the purchase price.

Our goal is to ensure your purchased vehicle or parts reach you safely and efficiently. We will work closely with you on the logistics. It is important that you stay responsive during the shipping process and provide any information or documentation we or the shippers require. Good communication will help avoid issues with delivery and collection.

11. Export Documentation and Compliance

Because MyExportDeal specialises in export sales, there are important terms regarding export documentation and legal compliance for international vehicle/parts transactions:

  • Provision of Documents: We will provide you with all standard documents required to export and subsequently import the vehicle or parts to your destination. These typically include:
    • Original commercial invoice (proof of sale)
    • Bill of Lading or Airway Bill (issued by the carrier upon shipment)
    • Export Certificate or proof of vehicle de-registration for export (for vehicles, if applicable in the UK)
    • V5C (UK logbook / vehicle registration document) or equivalent proof of prior registration/ownership, signed over to you (for vehicles)
    • Any available service records or history documents that came with the vehicle (if applicable)
    • Certificate of Origin (for parts, if required, or for new vehicles if needed)
    • Insurance documents (if marine insurance was purchased)
  • Accuracy of Information for Export: You agree to promptly provide any information we request that is necessary for export or shipping paperwork. This may include personal or company details (name, address, identifying information), your importer ID or customs broker information, etc. You vouch that all information you provide for documentation will be truthful and accurate. We are not responsible for delays or fines arising from incorrect information you provide.
  • Compliance with Export Controls: We will not export to countries or individuals that are prohibited by UK law, international sanctions, or other export control regulations. By placing an order for export, you confirm that you are not located in a sanctioned country, not on any government list prohibiting business with you, and that the items will not be used for any illegal or prohibited purpose. We may request end-user statements or conduct background checks if required by law. If we discover a compliance issue that prevents us from exporting to you (e.g., new sanctions, or misrepresentation of your identity or intentions), we reserve the right to cancel the sale. In such case, if no fault of yours (e.g., sudden legal change), we will refund payments made; if you misled us, we may withhold amounts to cover costs or damages.
  • Import Responsibilities: Laws and regulations vary by country. It is solely your responsibility to ensure that the import of the vehicle or parts into your country is legal and to obtain any necessary import permits or licenses. MyExportDeal is not responsible for any refusal by your local authorities to allow import, or any requirements they impose that were not communicated to us. We will assist by providing documentation, but we cannot guarantee approval by customs or registration authorities in your country.
  • Emissions and Standards Compliance: Some countries have specific standards (emissions, safety, etc.) that vehicles must meet to be imported or registered. We make no guarantee that any vehicle meets standards outside of its market of origin (e.g., a UK-spec vehicle may not meet U.S. DOT or EPA standards without modification). It is your duty to check such requirements before purchase. If modifications or certifications are needed, you will have to arrange those at your own cost.
  • Export Only Sales: Certain vehicles or parts we sell might be designated “Export Only.” This could be due to their condition, age, or status (for instance, a vehicle that cannot be registered in the UK or EU might be sold for export to regions with different regulations). If an item is marked as Export Only, you agree not to attempt to use or register it in the UK/EU unless it is brought into compliance independently. MyExportDeal will not be liable for any issues arising from misuse of an Export Only item domestically.

This section ensures both parties are clear on their roles in the complex process of international sales. We handle the export process on the UK side and provide documentation, while you handle the import side in your country. Teamwork and clarity here prevent legal complications and ensure a successful handover of your purchase.

12. Condition of Vehicles and Parts; Warranties Disclaimer

We want you to be satisfied with your purchase, but it’s important to understand the condition and warranty (or lack thereof) for the vehicles and parts we sell:

  • Vehicle Condition Reports: For each used vehicle, we can provide a condition report upon request, which may include information on mechanical condition, bodywork, interior, and any known issues or defects. Despite this, used vehicles inherently may have wear and tear or latent defects that are not immediately evident. Unless explicitly stated, assume no refurbishment has been done beyond standard cleaning and basic checks.
  • Sale “As-Is” for Used Items: Used vehicles and used parts are sold “as-is” and “with all faults.” This means that except for any conditions explicitly guaranteed in writing, the buyer accepts the item in the condition existing at the time of sale, with any faults or imperfections. We do not provide a post-sale warranty on used items. It is crucial that you satisfy yourself as to the condition of the used vehicle or part before completing the purchase. We encourage inspections and will assist with scheduling them if you wish.
  • New Parts or Products: If we sell any new parts or accessories, these may come with a manufacturer’s warranty. We will pass along any such warranty and relevant documentation. However, we (MyExportDeal) do not independently warranty those items beyond the manufacturer’s guarantee. Any claims for defects on new products should be directed to the manufacturer, though we can assist in facilitating such claims.
  • No Implied Warranties: To the fullest extent permitted by law, we exclude all implied warranties and conditions. This includes any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. In plain terms, we are not guaranteeing that a vehicle or part will be fit for any particular use you have in mind, except as stated in the item description. You are responsible for ensuring the item’s specifications meet your needs (for example, that a vehicle model is allowed in your country, or a part is compatible with your vehicle) prior to purchase.
  • Odometer Readings and History: For vehicles, we will provide the odometer reading as shown and share any history information we have (such as service records or accident history if known). However, especially for older or imported used vehicles, we may not have a complete history. We cannot guarantee the accuracy of the odometer reading or that the vehicle’s history is free of any undisclosed events. We will never knowingly misrepresent these details, but if exact mileage or history is critical, please investigate to your satisfaction (e.g., via history check services or inspections).
  • Remedies for Misdescription: Our policy is that sales are final, but if a vehicle or part you receive is grossly not as described in the contract of sale (for example, we shipped the wrong model, or a part is a different specification entirely than what was ordered), contact us immediately. While we do not generally do returns, we will correct errors that are undeniably our fault: for instance, retrieving and replacing an incorrect part, or in extreme cases, refunding a purchase that was fundamentally misrepresented. Minor differences or imperfections, especially those consistent with used condition, will not qualify for any refund or compensation.
  • Third-Party Inspections and Tests: If you arrange a third-party inspection or test (such as a pre-shipment inspection required by your country or a certification like BV, SGS, or Bureau Veritas for certain countries), we will facilitate access for the inspector and cooperate. The costs of any such inspection are usually yours, unless required by us. If a third-party inspection report is unsatisfactory, we can discuss how to proceed (for example, fixing an issue or canceling the sale as per the deposit refund terms if it falls under an agreed condition).

In summary, we want to be transparent about what you are getting. Many of our customers are purchasing remotely, so trust is key. We aim to provide accurate descriptions and support due diligence. However, once the sale is completed, the responsibility for the item’s condition is yours, and MyExportDeal will not be liable for issues that arise thereafter unless we intentionally misled you or otherwise required by law.

13. Limitation of Liability

While we will always strive to meet our obligations and deliver quality service, MyExportDeal’s liability to you is limited as set out below. By using our Site or buying products from us, you agree to these limitations:

  • No Liability for Indirect Damages: To the fullest extent permitted by law, MyExportDeal and its directors, officers, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes (but is not limited to) losses such as loss of profits, loss of revenue, loss of business opportunity, loss of data, or inconvenience, even if we were advised of the possibility of such damages. For example, we are not liable if a delay in shipping causes you to miss a resale opportunity, or if a part being faulty causes downtime – beyond the remedies explicitly provided for the product itself.
  • Liability Cap: To the extent we are found liable for any claim arising out of these Terms or your use of our services, our aggregate liability shall not exceed the amount you paid to us for the vehicle or parts in question. If the claim does not relate to a specific product purchase, our liability is capped at an amount of £100. This limitation applies whether the liability arises from breach of contract, tort (negligence, etc.), or any other legal theory.
  • No Liability for Third-Party Services: We may recommend or assist you in arranging third-party services (such as inspections, financing, shipping, or registration assistance). However, we are not responsible for the conduct, errors, or omissions of third parties. Any contracts or arrangements made with third-party providers are solely between you and that provider, even if we helped facilitate the contact. For instance, if a shipping company delays delivery or an inspection service misses a defect, you must address those issues with the respective third party.
  • Site Use: We strive to keep the Site available and secure, but we do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Site at your own risk. We shall not be liable for any damage to your computer system or loss of data that results from use of the Site (such as downloading material from the Site).
  • No Liability for Information or Advice: Any information or guidance provided on the Site or by our staff (for example, general advice on exporting, guidance on a vehicle’s suitability for certain uses) is given in good faith but without a guarantee of accuracy or completeness. You should seek independent professional advice for important matters (such as legal import regulations or mechanical assessments). We will not be liable for actions you take in reliance on informational content on our Site.
  • Non-Excludable Liability: Nothing in these Terms seeks to exclude or limit liability that cannot be excluded by law. In particular, we do not exclude liability for: (a) death or personal injury caused by our negligence, or (b) fraud or fraudulent misrepresentation, or (c) any breach of obligations implied by applicable law that cannot be lawfully excluded. If you are a consumer with rights under mandatory laws (like certain consumer protection laws), those rights are not overridden by these Terms.

By understanding these limitations, you acknowledge that there are risks in any vehicle or part purchase, especially across borders, and you agree that our liability is limited to providing you either the product as described or, failing that, a remedy up to the value of what you paid. We recommend you consider insurance (for shipping, and perhaps mechanical breakdown warranties via third parties for vehicles) to further protect your purchase, as we cannot cover those consequential risks for you.

14. Indemnification

You agree to indemnify, defend, and hold harmless MyExportDeal, its owners, directors, employees, affiliates, and agents, from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your Breach: Any breach by you of these Terms or of any warranty/representation you provide to us under these Terms. For example, if you provide false information during a transaction or violate a condition (like re-exporting to a sanctioned country) and a claim is brought against us as a result, you would cover those losses.
  • Your Violation of Law or Rights: Your violation of any law or regulation, or the rights of any third party, in relation to your use of our Site or purchase of goods. This could include, for instance, intellectual property infringement if you use content from our Site improperly, or issues arising from your importation and use of a vehicle in another country.
  • Your Own Agreements: Any contracts or agreements you enter into with third parties through or thanks to our platform (such as a contract with a shipping company or an inspection service) – essentially, we won’t be drawn into disputes between you and other service providers.

This indemnification means that if a third party (including a governmental body) makes a claim against MyExportDeal due to your actions or negligence, you will reimburse us for any costs or losses we incur as a result of that claim. We will notify you promptly of any such claim and, where possible, give you the opportunity to assist in defending or resolving it. Your obligation to indemnify will survive the termination of these Terms and the conclusion of any transaction with us.

15. Intellectual Property Rights

All content and materials on the MyExportDeal.co.uk Site are protected by intellectual property laws. The following outlines our policy on intellectual property (IP) and your permitted use:

  • Site Content: The Site’s design, text, graphics, logos, button icons, images, data compilations, and software are either the property of MyExportDeal or used under license. All rights are reserved. You may not reproduce, copy, modify, distribute, or create derivative works from any portion of the Site without express written permission from us, except for personal use in relation to evaluating or purchasing our products.
  • Trademarks: “MyExportDeal” and our logos, slogans, or trade dress may be registered or unregistered trademarks of our company. Any other trademarks displayed on the Site (for example, vehicle manufacturer logos or brand names in listings) remain the property of their respective owners. Use of those trademarks on our Site is nominative (e.g., to describe a car of that brand) or under license. Nothing in these Terms grants you any license or right to use any trademark displayed on the Site without the owner’s prior written permission.
  • User-Submitted Content: If our Site allows you to submit content (such as reviews, comments, or vehicle listings if you are a partner dealer), you retain ownership of that content. However, by submitting content, you grant MyExportDeal a worldwide, royalty-free, perpetual, sub-licensable license to use, reproduce, modify, publish, translate, distribute, and display that content in connection with operating and promoting our Site and services. You represent that you have the necessary rights to grant us this license for any content you submit and that your content does not infringe the rights of any third party. We reserve the right to remove any user-submitted content that violates laws or these Terms.
  • Third-Party Intellectual Property: We respect the IP rights of others. If you believe that any content on our Site infringes your copyright or other IP rights, please notify us with detailed information so we can investigate and remove or disable access to the infringing material if appropriate. We may require proof of your rights and a clear identification of the content in question. Our contact information for IP concerns can be found in the Contact section of these Terms.
  • Limited Permission: You are permitted to print or download extracts from the Site for your personal reference only for the purpose of considering or completing a purchase from MyExportDeal. Any other use of extracts from our Site, beyond what is allowed by law (such as fair dealing exceptions), is prohibited without our prior consent.

Remember that unauthorised use of intellectual property may not only violate these Terms but could also violate copyright, trademark, or other laws and could result in civil or criminal penalties. We take the protection of our IP (and that of our partners) seriously, just as we respect the IP rights of others.

16. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data in connection with your use of MyExportDeal.co.uk is governed by our Privacy Policy (available via the link in our website footer). By using our Site or providing us with personal information, you consent to such processing as described in the Privacy Policy. Key points include:

  • Data Collection: We will collect personal information that you provide to us (such as your name, contact information, and shipping details) as well as data generated from your use of the Site (such as inquiry history or site usage via cookies). This information is used to facilitate your orders, improve our services, and communicate with you.
  • Data Use: We will use your information in accordance with applicable data protection laws. Primarily, we use it to process transactions (e.g., sharing necessary details with shipping companies or customs documentation) and to keep you updated on your order. With your consent, we may also send marketing communications, which you can opt out of at any time.
  • Data Sharing: We will share your personal data with third parties only as needed for business operations or when required by law. For example, providing your name and address to a logistics provider for delivery, or to customs authorities for export/import purposes. We do not sell your personal data to third-party marketing companies.
  • Data Security: We implement appropriate technical and organisational measures to protect your data against unauthorised access, alteration, or deletion. However, no system can be 100% secure, so we cannot guarantee absolute security of data. You also play a role in security by keeping any account credentials confidential.
  • Your Rights: Depending on your jurisdiction (for example, under the UK GDPR/Data Protection Act or other applicable privacy laws), you have rights regarding your personal data. These may include the right to access the data we hold about you, correct any inaccuracies, request deletion of your data, or object to certain processing. Our Privacy Policy details how you can exercise these rights, typically by contacting us with your request.
  • Cookies: Our Site uses cookies and similar technologies to enhance user experience (such as keeping you logged in, remembering preferences, or analytics). Our Privacy Policy or a separate Cookies Policy (if available) provides details on what cookies we use and how you can control them.

For full details, please review our Privacy Policy. By agreeing to these Terms, you also acknowledge reading and agreeing to the Privacy Policy. If you have any questions about how we handle your personal information, you can contact us as described below in the Contact Information section.

17. Termination and Suspension

We reserve the right to suspend or terminate your access to MyExportDeal.co.uk and our services at our discretion, with or without notice, if you violate these Terms or engage in any activity that we deem harmful, fraudulent, or otherwise objectionable. Circumstances that may lead to termination or suspension include (but are not limited to):

  • Breach of Terms: Any material breach of these Terms, such as non-payment of amounts due, attempted fraud, or violation of intellectual property rights.
  • Illegal Activity: Use of our Site to conduct any illegal activities, or attempts to compromise the security or integrity of our systems.
  • Abusive Behaviour: Threatening, abusive, or harassing behaviour towards MyExportDeal staff or other users, or any misuse of communication channels provided by the Site.
  • False Information: Providing false, outdated, or misleading information in your dealings with us (for example, false identity, false claims about authority to buy or sell, etc.).

If your account or access is terminated, any pending orders might be canceled at our discretion (with deposit outcomes determined per the cancellation terms above). We also reserve the right to refuse future service or access to anyone who has violated these Terms in the past. Conversely, you are free to discontinue use of the Site at any time. If you have an account, you may request that we deactivate it. However, note that any obligations incurred before termination (such as payment for a product already ordered or shipped, or indemnification obligations) will survive termination of your relationship with us.

18. Changes to These Terms

MyExportDeal may update or modify these Terms and Conditions from time to time. Changes are typically made to reflect new services, changes in law, or improvements in our policies. When we make changes:

  • Posting of Updates: We will post the revised Terms on this page with an updated “Last Updated” date at the top (or bottom) of the Terms document. Revised Terms are effective as of the date they are posted, unless otherwise noted.
  • Notice: For significant changes that materially affect your rights or obligations, we may provide additional notice of the update (for example, via email to registered users or a pop-up notice on the Site when you log in or go to the checkout). However, it is ultimately your responsibility to review the Terms periodically for any changes.
  • Your Acceptance of Changes: By continuing to use the Site or our services after the Terms have been updated, you are agreeing to the revised Terms. If you do not agree to the changes, you should stop using the Site and services, and (if applicable) contact us to terminate any account you have. For any order that was placed before a change in Terms, the Terms that were in effect at the time of order will generally apply to that transaction.

We encourage you to save or print a copy of these Terms for your records and to check back occasionally. We aim to be transparent with our terms and welcome any questions you might have when we issue updates.

19. Governing Law and Jurisdiction

These Terms and Conditions, and any separate agreements by which we provide you services or sell you products, shall be governed by and construed in accordance with the laws of England and Wales. This means that the interpretation and enforcement of these Terms are subject to English law, regardless of which country you access our services from (note: if you are a consumer based outside of the UK, you may also be entitled to the protection of mandatory consumer laws in your country of residence).

In the event of any dispute or claim arising out of or in connection with these Terms or your use of the Site or our services (including non-contractual disputes or claims), you and MyExportDeal agree that such disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. By “exclusive jurisdiction,” we mean that if a dispute is to be resolved in court, it shall be brought to an appropriate court in England (typically, the courts of London, unless another location in England or Wales is more relevant), and that both parties submit to that jurisdiction.

However, if you are purchasing as a consumer (and not for business purposes) outside of the UK, you may additionally have the right to pursue claims in your local courts under local law. These Terms do not limit any such rights you have under applicable consumer protection laws.

Regardless of jurisdiction, we hope to resolve any disagreements in an amicable and efficient manner. If you have concerns or a dispute, we encourage you to contact us first to discuss a resolution before resorting to legal action.
